A former employee emails Breaking Code Silence a request to receive a copy of their 990s, IRS Form 1023 or Form 1024, and an exact copy of Form 990-T including schedules, attachments, and supporting documents.

Vanessa Hughes replies to the former employee that they are not delinquent and that they simply “do not yet possess the requested documents.”

Vanessa Hughes further replies to the former employee’s follow-up emails about which documents are available to produce. Ms. Vanessa Hughes states “that information is not important to share with the general public as I’m sure you can understand.”

After not receiving the 990s in 2022, the former employee emails Breaking Code Silence again after almost 6 months to request the 990s again.

After not receiving a response, the former employee emails what she believes is the entire Breaking Code Silence board and informs them that it has been 36 days since she requested the 990s.
Per the IRS, 501(c)(3) has to make its 990s available for public inspection within 30 days of a request by a member of the public. She never has received a copy of the 990s to date.

Breaking Code Silence’s third fiscal year ends.
Under information and belief, Breaking Code Silence submits a 990-N postcard only for the fiscal year ending on 6/30/2021.
According the IRS website, Breaking Code Silence has not yet submitted 990s for the fiscal years ending on 6/30/2022 and 6/30/2023. The Form 990 is due on the 15th day of the 5th month following the end of the organization’s taxable year.
